1. The Ntathu Account

Account Creation: To access most Services, you must create a Ntathu Account. Our primary method of account creation and verification is through a valid phone number. You may also be able to sign up using a third-party provider like Google.

Account Security: You are responsible for all activity that occurs under your Ntathu Account. You must keep your login credentials secure and confidential. You agree to notify us immediately of any unauthorized use of your account.

Age Requirement: You must be at least 18 years old to create a Ntathu Account.

Account Information: You agree to provide accurate and complete information when creating your account. You are responsible for keeping this information up to date.

2. General User Conduct

3. Termination

Our services are provided as is without any warranties, express or implied. Ntathu does not guarantee that the services will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Ntathu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of our services.

5. Governing Law

These Terms shall be governed by the laws of the Republic of Zimbabwe, without regard to its conflict of law provisions.

6. Additional Terms for Specific Services

By using any Service, you agree to the additional terms applicable to that Service, which are listed below. These terms form part of your agreement with us.

a) Additional Terms for Ntathu AI

Service Description: Ntathu AI is an artificial intelligence assistant that allows you to interact with various large language models.

Billing: We offer two ways to pay for Ntathu AI:

• Pay-As-You-Go (PAYG): You can purchase Top-Up credits in USD. These credits are for your use only and are non-refundable and non-transferable. PAYG credits expire thirty (30) days after the date of purchase.
• Pro Subscription: A recurring monthly subscription billed in USD. Subscribers receive a monthly allotment of credits with bonus value. Subscription credits do not expire as long as your subscription remains active. If you cancel your subscription, any remaining subscription credits will be forfeited at the end of your billing cycle.

WhatsApp Usage: Use of Ntathu AI via WhatsApp may incur a surcharge for PAYG users. This surcharge is waived for active Pro Subscribers.

b) Additional Terms for Ntathu Creators

Service Description: Ntathu Creators is a platform that allows Creators to receive monthly financial support from Patrons.

Our Role: We are a platform provider and payment intermediary. We are not a party to the agreement between a Creator and a Patron. We are not responsible for the quality, delivery, or legality of the content or perks offered by Creators.

Terms for Patrons: You are making a recurring monthly payment directly to a Creator. Ntathu will process this payment on behalf of the Creator. Pledges are charged on a recurring monthly basis until you cancel. Payments are non-refundable. You can manage your pledges in your account settings.

Terms for Creators: You will set up a page and offer membership tiers. For every pledge you receive, Ntathu will deduct a platform fee (as displayed on your Creator dashboard) before paying out the remainder to your designated payout account. You are solely responsible for fulfilling any perks you promise to your Patrons and for any taxes on your income. Payout information is handled by our secure third-party payment processors.

c) Additional Terms for Ntathu Connect

Service Description: Ntathu Connect provides Wi-Fi access at partner venues.

Service Provision: By accessing Wi-Fi through Ntathu Connect, you agree to view an advertisement. The service is provided as-is and we make no guarantees about the speed, reliability, or security of the network.

User Choice: Creating a Ntathu Account is optional. Standard access is available to all users. If you choose to log in with your Ntathu Account, you may receive bonus access (such as extended time or additional features).

Fair Use: You agree to use the service in accordance with our Acceptable Use Policy and not to engage in activities that monopolize network resources or degrade service for other users.

7. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on our website. If a revision is material, we will notify you. By continuing to use the Services after revisions become effective, you agree to be bound by the revised Terms.
